Aawaz dot com skill Terms of Use These Terms of Use (the “ToU”) are an agreement between you and Aawaz.com (“Aawaz.com”, or “us”, “we” or “our”). The ToU governs your use of the Aawaz Podcast Skill on Alexa-enabled devices, by enabling using our Aawaz dot com Skill(the “Skill”) to play shows, episodes of various categories which are available in aawaz.com website. This agreement applies in addition to any other contract or agreement that you may have with Aawaz.com . Skill Services are accessible via Alexa Skill on Alexa Application from Alexa, i.e. cloud-based voice service available on devices from Alexa and/or their affiliates (“Alexa”) and third-party device manufacturers, (“Device”), using specific Skill developed for Aawaz.com. Before using the skill, please read the ToU and other legal documents. If you enable skill, you confirm that you have read, understood, accept and agree to our TOU. If you do not agree to the TOU in its entirety, then please do not use the Skill.

Definitions: In these TOU, the terms:

Requirements To use the skill, requires (1) Smart phone or Alexa enabled devices. Skill is currently available in English and Hindi languages only. If any of these requirements do not apply to you, do not use the skill. To use the skill, you will need to enable the skill via a smartphone Alexa App. Aawaz.com accepts no liability for any damage to your or any other person’s computer or device relating to or resulting from using the skill or enabling the App. Permanent availability of skill cannot be guaranteed. Aawaz.com shall not be responsible for any costs associated with using the skill including the purchase and use of Device, internet, Data connection charges etc. and shall be borne by you. You may contact our Customer Care Centre for information on availability. Using Aawaz.com skill is free, designed and developed solely for use at your Home for personal use and is not intended for illegal or commercial purposes in any form. We will never ask you for your credit card or other payment information. The skill enables you to explore the various features and listen to different podcasts ,shows and episodes and also various categories like Music,comedy,cricket,entertainment ,devotional etc., Aawaz.com may add or modify or remove any show or episodes from time to time without notice. Other terms may apply to your use of a specific feature of our skill. If there is a conflict between the TOU and terms posted for a specific feature, the latter terms apply to your use of that feature. You shall not regard the information of skill as a professional vehicle concierge or advisor. Aawaz dot com skill is not responsible for any kind of misunderstanding by any one regarding the motive of this skill.

Security:

It is advised to use the skill only in a secured and private setting and also in the presence of others, including children. Depending on the settings of your Device, it may be possible for you to allow other users’ access to the skill. You can delete specific voice interactions associated with your account by going to 'History' in 'Settings' in the Alexa App, drilling down for a specific entry, and then tapping the delete button. You can delete all voice recordings associated with your account. By allowing other users to access and/or use the skill, you assume complete liability and responsibility for access to/ using the skill and/or any information obtained from the skill by the users and Aawaz dot com will not be liable for any use of the skill by users. Using the skill consists of speaking commands and questions aloud to your Device, and then receiving responses from us through your Device. When you use the skill, Alexa skill relays your queries to the Aawaz.com, retrieves requested information and presents it to you. Any questions and commands given via Alexa will be treated as authorized by you. Any response Alexa provides will be given as authorized by you to do so. In order to provide and improve the services, we may record and keep data on your interactions with Alexa and/or the skill . By accepting this Agreement, you understand and agree that we may perform said actions in order to provide and improve their services. Consent You declare and agree that the relevant data are provided to us for the purpose of providing Skill or Alexa Skill. When asking Alexa skill for information, it will be retrieving this information for you and you agree to Aawaz.com performing this. Aawaz.com may also record your interactions with the skill or with Alexa skill and shall handle the personal data concerned. Skill may not hear you properly, may misinterpret what you say, or may say something to you that is different from the information that Aawaz.com provided to Alexa Skill in response to your question. We also cannot guarantee that the Content and Services will help you achieve any specific goals or results. Aawaz.com therefore accepts no responsibility for any damage, loss, liabilities or injury incurred or suffered by you or by third parties as a result of using the skill, including as a result of Aawaz.com providing inaccurate, untimely, incomplete or erroneous information. Aawaz.com reserves the right to modify or discontinue the skill at any time without prior notice. The number and range of services offered via Device may change over time and depend on current offer and availability. Aawaz.com provides you solely with access to information. Intellectual Property Rights is owned by aawaz.com and all rights are reserved by Aawaz.com . Access to information or impair them or interfere with any third party rights will be considered as Unauthorized access. Such unauthorized access will be considered as violation of TOU and applicable laws (including but not limited to Privacy & Security, Information & Technology, Criminal and Civil laws). All materials, including images, designs, icons, photographs, video clips, audio clips, recordings, animation, contents etc. written and other materials of the Action (including any update, upgrade & enhancement) and other Services and copyrights, trademarks, trade dress, designs and/or other intellectual properties are owned, controlled or licensed by Aawaz.com and/or licensors and other third parties, who reserve the rights in law and equity and are protected by copyright and other intellectual property laws. You are hereby granted a nonexclusive, non-transferable, non-assignable, limited license to view, access and use the skill from Aawaz dot com, our licensors & other third parties. Except as expressly provided above, no part of the Contents, including but not limited to materials retrieved there from and the underlying code, may be reproduced, republished, transmitted, displayed, posted or distributed in any form or by any means by you. Termination Aawaz.com may terminate your access to the skill at any time and without notice if you fail to comply with any of terms herein. Aawaz.com may also terminate your access to the skill if the skill is no longer available. You can cancel your using skill at any time by calling our Customer Care Centre.

Limitation of Liability:

Aawaz.com accepts no responsibility and liability for any damage, loss, injury or disappointment incurred or suffered by you as a result of using the skill, including as a result of us and/or our partners providing inaccurate, untimely, incomplete or erroneous information. Dispute Resolution Arbitration: Any dispute relating to enforcement, interpretation or application of these terms and conditions shall be subject to Arbitration of Sole Arbitrator to be appointed by Aawaz.com. The venue & seat of Arbitration shall be at Chennai. The Arbitration Proceedings shall be in accordance with the Arbitration and Conciliation Act, 1996 or re-enactment or as amended from time to time. Governing Law & Jurisdiction: The interpretation of these terms and conditions shall be constructed in accordance with the laws of India. Subject to Arbitration clause above, any disputes arising under or in connection with the use of Application or service or the Terms shall be subject to the exclusive jurisdiction of the competent Courts in Chennai, India. Time Limits. Except where prohibited by law, you are not allowed to bring any claim against Aawaz.com (or any other third party beneficiary) more than one year after the claim arises.

GENERAL:

Aawaz.com reserves the right to amend the ToU from time to time. The latest version of ToU shall be always available on Aawaz.com website and skill on Alexa from Alexa App. Any amendments shall become part of the ToU if you received notification of the amendments from Aawaz.com. If you continue to use the skill after the amendments have taken effect, we will assume that you agree with the amendments and they shall become effective for you. Should you object to the amendments, the amendments shall not be effective for you and as a result you shall not be entitled to use the skill anymore. The TOU should be read in conjunction with our aawaz.com Acceptance of Terms of Use and other legal documents such as privacy and cookie policies as amended, as provided for aawaz.com. In the event of a conflict between any provision contained in this TOU and any provision of any other document (including aawaz.com Terms of Use, Privacy Policy) incorporated herein, the provision contained in this TOU shall take precedence only to the extent of such variation, and no additional or different terms shall be binding on either of us unless agreed to in writing. Section titles contained herein are for convenience only. If any part of these Terms and Conditions is considered invalid or unenforceable under any applicable law, the rest of it will remain enforceable. Even after the skill Service has ended, this TOU will govern any disputes arising out of or relating to it. By using the skill, you agree to the ToU, separate terms and conditions of the Device. You shall not use the skill if you do not agree to all these above mentioned terms and conditions of Aawaz.
